This Policy describes the types of Information we may collect from you when you access or use the RestroZap website located at https://www.restrozap.com/ (the “Site”), or access or use the RestroZap mobile application (the “App”), or when you use or interact with any other products, applications, or features provided by us (collectively, the “Service”), as well as our practices: for collecting, using, maintaining, protecting, and disclosing that Information. In addition, any capitalized terms used but not defined in this Policy shall be given the meaning ascribed to them in our Terms of Service.
If you disagree with this Policy and our practices, you should not use the Service. In addition, there may be changes in this Policy from time to time. We will notify you of material changes, but it is your responsibility to check this Policy for updates periodically.
Collection of Information
Information collected in connection with your use of the Site/Service may include the Information you provide, such as:
- 01 Contact information includes your contact name, email address, street address, and phone number.
- 02 Transaction information includes Information about your payments and other details of orders, products, or services you have purchased from the Restaurant and reservations you have made.
- 03 Our third-party payment processor collects payment details, such as the payment card information and the billing details; we will not obtain access to individuals’ payment card numbers when you make a purchase. We also offer a choice to save your payment information only to make it easier for you to make further subscription purchases and renewals on our platform.
- 04 Feedback or correspondence, such as the Information you provide while you contact us with your questions, feedback, or otherwise correspond with us online.
- 05 Other Information that you may choose to provide to us voluntarily reflects our offline interactions with you.
- 06 Cookies and Other Information Collected by Automated Means. Our other third parties and we may automatically collect Information about you, your computer or mobile device, activity occurring on or through the Site, and Our Service.
- Information about your device’s hardware, such as your device model and your device’s screen resolution.
- Information about your device software, such as your browser type.

We Do Not Collect Information from Minors
We do not knowingly solicit data from or market to children under 18. By using the Service, you represent that you are at least 18 or the parent or guardian of such a minor and consent to such minor dependent’s use of the Site or App. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to delete such data from our records promptly. Advertisements & Their Display
We work with advertising partners to show the Restaurant's advertisements online. Our advertising partners deliver these advertisements and may be targeted based on your use of the Site or your activity elsewhere online. To learn more about your choices concerning advertisements, please see the section below titled "Targeted online advertising."
For the Purpose of Compliance, Fraud Prevention, and Safety
We may use your personal information, and we may disclose it to the law enforcement, government authorities, and private parties as we believe is necessary or appropriate to:
- Comply with any applicable laws, lawful requests, and legal processes, such as responding to subpoenas or government authorities' demands.

Disclosure to Restaurants
Suppose you are a Restaurant Customer and placed an order using the Service or through a Restaurant's website that uses the Service to process the orders. In that case, your personal information and payment Information may be viewed and retained by the Restaurant and/or by the individuals working for the Restaurant or on behalf of the Restaurant. We share Information about the Restaurant Customer orders to be processed by or on behalf of each Restaurant for the Restaurant to process and facilitate the orders. The Information we share with Restaurants to enable and process your order may include your name, phone number, order information, payment information, and other details. Restaurants may use your Information to directly contact you about the orders, including confirming your order or sending you updates about your order's status. In addition, we allow the Restaurants to export such Information outside the Service. It may publicly distribute Your Information outside the Service in perpetuity. We expect Restaurants to handle all the Information following applicable law and this Policy. Still, we cannot control how your Information is retained and/or used by the Restaurant and/or by the individuals working for or on behalf of the Restaurant outside of the Service.
We may engage other companies, third parties, and individuals to perform certain business-related functions (including technical assistance, payment processing, billing, email management, customer service, marketing assistance, order fulfillment, delivery services, and reservation and online ordering systems) on Our behalf. We authorize these parties to use Your Personal Information to the extent necessary to perform their functions.
Disclosure to Restaurants
When You share Your Personal Information by placing orders as a Restaurant Customer, Your Personal Information may be viewed or retained by a Restaurant. We share Your Information about Restaurant Customer orders to be processed by or on each Restaurant's behalf, facilitating the Restaurant to process and handle the orders. Our role in this is of a Service provider for the Restaurants, and we do not sell your data to any other third parties. The Information we share with the Restaurants to facilitate and process your order may include your name, phone number, order information, and further details. Restaurants may use your Information to directly contact you, whether to confirm your order or send you updates about your order's status. In addition, we allow Restaurants to export such Information outside the Service, which may publicly distribute your Information outside the Service in perpetuity.
Suppose you establish an account for this checkout functionality. In that case, you may direct RestroZap to share your payment information with any restaurant that operates on our platform when making subscription purchases using their account.
In connection with or during any negotiation of financing, merger, acquisition, dissolution or similar corporate event, or the sale of all or some of RestroZap's or the Restaurant's assets, the Information that RestroZap or the Restaurant, as applicable, have collected, including Personal Information, may be transferred as a business asset. For example, suppose another company acquires the company, business, or assets; in that case, the acquiring company will possess the Personal Information that RestroZap or the Restaurant, as applicable, collected and assumes the rights and obligations about Your personal Information as explained in this Policy.
If required, we may disclose your Information to do so by the law or in good faith or belief that such action or disclosure is necessary or appropriate to

Cookies & Browser Web Storage
Many browsers, by default, accept the cookies until you change your cookie settings. Please note that if your browser is set to disable cookies, the Site may not work correctly. Similarly, your browser settings may allow You to clear your browser's web storage.
Targeted Online Advertising
Some third parties that collect information about the Users' activities on or through the Site or Service may be the members of organizations or programs providing choices to the individuals on the use of their browsing behavior and mobile application for the targeted advertising purposes. For example, users may opt out of receiving targeted advertising on websites through the Network Advertising Initiative members by clicking here or by the Digital Advertising Alliance by opting to unsubscribe. Please note that we may work with companies or third parties that offer opt-out mechanisms which may not participate in the opt-out mechanisms as linked above.
When you choose to opt-out of targeted advertisements, you will still see advertisements online which are irrelevant to you. Furthermore, not all companies serving online behavioral advertising are included in this list even when you decide to opt-out. Hence, you may still receive some cookies and tailored advertisements from not listed companies.
Do Not Track
Some Internet browsers may be configured to send "Do Not Track" signals to the early visited websites. Currently, the Restaurant does not monitor, recognize, or honor any opt-out or do not track mechanisms, including any general web browser "Do Not Track" settings and/or signals, in connection with the Site or Service.
Protecting Your Information
We implement security measures designed to protect your Information from unauthorized access, use, or disclosure. We protect your Information from potential security breaches by implementing technological security measures, including encryption, firewalls, and secure socket layer technology. However, these measures do not guarantee access to your Information, disclosed, altered, or destroyed by breach of such firewalls and secure server software. Using our Service, You, by default, acknowledge that you understand and agree to assume any of these risks. RestroZap shall not be responsible for circumventing any of the Service’s privacy settings or security measures. We urge You to take the necessary steps to keep your account information (username and password) protected from any unauthorized use by others if you have an account. In addition, you should only access the services within a secure environment.
Global Data Transfers
The Site and its servers are located in the US, and we may have service providers and other third parties in other countries. Therefore, if you are located outside of the US, be aware that any information provided to us, including Your Personal Information, will be transferred from Your country of origin, the US to other locations outside of Your country, where privacy laws may not be as protective as those in your country.
Notice For The Individuals Of The European Economic Area (EEA)
Concerning personal data received or transferred under the Privacy Shield Framework, RestroZap is subject to the regulatory enforcement powers of the US Federal Trade Commission.
According to the EU-US Privacy Shield Framework, individuals have the right to access Personal Information and limit its use and disclosure. You may request to provide you with access to Your Personal Information. You may also ask to correct, amend, or delete the personal information we hold about you. Under the Privacy Shield, an individual seeking to access, correct, amend, or delete inaccurate data transferred to the United States should contact us at email@example.com, with the subject line, “Privacy Shield.” If we receive a request to exercise such rights under Privacy Shield from a user of the Site or Service, we will direct that end-user to contact our client(s) with the request. We will assist the client(s) in fulfilling the request with their instructions.
In this regard, we may require payment of a non-excessive fee to defray our expenses. Please allow us some reasonable time to respond to your inquiries and requests.
In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We may also disclose personal information to other third parties when compelled to do so by government authorities or required by law or regulation, including, but not limited to, in response to court orders and subpoenas.
Exercising Your Rights & Request Verification
You have a right to non-discrimination, meaning we will not charge you different prices or provide different quality of services if you choose to exercise your rights- unless those differences are related to your Personal Information. In other words, if you are a Restaurant Customer requesting us to delete your Information, then your request limits our ability to process Personal Information inherently. Hence, we may no longer be able to provide you the Service to submit online orders.
You need not create an account with us to exercise your rights to opt-out; obtain or delete Your Personal Information. However, we may ask you to provide any additional Personal Information so we can correctly identify you to respond to your request. We will only use the Personal Information you provide in connection with an information and/or deletion request to review, comply, and track compliance. If you choose not to provide the Information sought by us, we may only be able to process your request to the extent where we can identify You in our data systems.
We need your full name and email address to verify any requests submitted by you to receive or delete your Information. We may also request you to confirm one or more Restaurants from where you placed an order and/or for an Order Number. You can submit a request to us by sending an email with your name, from the email address associated with your account, and a brief description of your request. Please submit all your requests to firstname.lastname@example.org with a subject line as "Privacy Request."
You may also designate an 'authorized agent' to make requests on your behalf. To respond to a request from an 'authorized agent' on your behalf, he/she must provide sufficient evidence demonstrating that he/she is an 'authorized agent' with written permission to act on your behalf.
In certain circumstances, if we suspect fraudulent activity and/or cannot verify your identity, we may decline a request described above, particularly. We will explain why we decline to comply with the request when we cannot comply with all or a part of your request.

The current section applies only if our privacy practices are governed by the California Consumer Privacy Act of 2018 ("CCPA") and only concerning the Site and the Service.

Privacy Rights of California Residents

You can request Information on how the Restaurant had collected, used, and shared your Personal Information during 12 months.
You can request a copy of Your Personal Information that the Restaurant maintains about You.
You may ask the Restaurant to delete the Personal Information that the Restaurant has collected or maintained about You.
Please note that the CCPA limits the above rights, for example, by prohibiting the Restaurant from providing certain sensitive Information in response to the access request made and restricting the circumstances in which the Restaurant complies with a deletion request.
If the Restaurant denies your request, it must communicate its decision to You. You are entitled to exercise the rights described above, free from discrimination.
Making a Request
To request access to Personal Information or deletion of Personal Information, contact the Restaurant via the same contact information provided on the Site.
Verification of Identity
The CCPA requires the Restaurant to verify the individual's identity while submitting any request before providing a substantive response to that request.
California residents can empower an 'authorized agent' in submitting their requests on their behalf. The Restaurant may require the 'authorized agent' to have a written authorization confirming that authority.

Description of the Program
RestroZap and its service providers may use automated technologies in delivering text messages to You while providing you with updates concerning orders placed using RestroZap ("RestroZap Order Updates").
Opting Out & Getting Help
To stop receiving text messages from RestroZap or If you need further assistance related to the SMS Terms, contact RestroZap customer service at email@example.com. Additionally, if you need help related to any orders, please contact the Restaurant at the contact information provided on the Restaurant's Site.
Frequency of Messages
The number of text messages you receive will recur and may vary depending on our interactions.
Your mobile carrier is not liable for any delayed or undelivered messages.
Access Or Delivery To The Mobile Network Is Not A Guaranty
It is wholly Your responsibility to determine if Your mobile carrier supports text messaging and if Your mobile device is capable of receiving any text messages. Your receipt of the RestroZap Order Updates is subject to your agreement(s) terms and conditions with Your mobile carrier.
Due to various circumstances or conditions, the delivery of Information and content to a mobile device may fail. You understand and thereby acknowledge that network services, including but not limited to the mobile network services, are outside of RestroZap's control. Accordingly, Restrozap is not responsible or liable for any issues arising from network services, including the delay or non-delivered messages or the security of any such messages).
Message and data rates might apply to each of the text messages sent or received concerning the RestroZap Order Updates, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans) and any applicable roaming charges. RestroZap does not impose a separate fee for sending the RestroZap Order Updates.
You must be a United States resident to receive the RestroZap Order Updates.
Change in Phone Number
By enrolling or otherwise agreeing to receive the text messages from or on behalf of RestroZap, you represent and also warrant that you are a current subscriber and/or authorized user of the phone number You provided. You also agree that you will not enroll or otherwise agree to receive messages from or on behalf of RestroZap using the mobile phone of any other person or entity without prior authorization, and if you change, forfeit, or deactivate the phone number you had provided to RestroZap, you agree to notify RestroZap immediately and failing to do so constitutes a material breach of these SMS Terms.
SMS Terms - Changes
RestroZap may update these SMS Terms without any prior notice. You agree to any changes by enrolling or otherwise agreeing to receive text messages from or on behalf of RestroZap.
